McGill-Lewis Law Group show contact info show contact info Mediation is a form of alternative dispute resolution, and is a way of resolving disputes between two or more parties without accessing the legal remedies available through in court procedures. A third party mediator assists the parties to negotiate their own settlement. In some cases, the mediator may express a view on what might be a fair or reasonable settlement, generally where all the parties agree that the mediator may do so. This is called a evaluative mediation. The process is private and confidential. There may be no obligation to go to mediation, but in some cases, any settlement agreement signed by the parties to a dispute will be binding on them. A mediated agreement may be registered with the court to make it legally binding and it is advisable to have a lawyer prepare the form or, at the very least, to obtain independent legal advice about the proposed terms of the agreement.
