We handle Chapter 7 and Chapter 13 cases. These are the chapters that persons with consumer debts usually file under.
Chapter 7 – Relief of most debts. You may be able to keep all or some of your property, like your home and car, depending on your individual situation. You do not have to pay any money from your income, but you might have give up some assets to pay your debts. You may or may not be able to file a chapter 7 based on your situation.
Chapter 13 – Allows persons receiving regular income to develop a repayment plan either of three (3) or five (5) years duration. During this time the law forbids creditors from starting or continuing collection efforts without court permission. You should be aware you cannot borrow money during the duration of the case without permission of the court. You are also prohibited from gambling while your case is ongoing. At the end of your case, if you have completed your plan and complied with the rest of bankruptcy code (We will advise you on what the bankruptcy code requires.), then you will be discharged from paying any remaining unpaid unsecured debts you have.
Bankruptcy can be a fresh start if you use it properly and understand your rights and responsibilities.
